Terms of Service
These Terms of Service (the “Terms”) are a legal agreement between you (“you”, “your”, or the “user”) and SoundVisualiser (“SoundVisualiser”, “we”, “us”, or “our”) governing your access to and use of the SoundVisualiser website, applications, and services that turn audio into rendered video (collectively, the “Service”). By creating an account, uploading content, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility & accounts
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. You are responsible for the accuracy of your account information, for keeping your password secure, and for all activity that occurs under your account. Notify us immediately of any unauthorised use.
2. Your content & the rights you must hold
“User Content” means any audio, images, logos, text, or other material you upload, import, or otherwise provide to the Service, and the videos rendered from it.
You may only upload or render content that you own or for which you have obtained all necessary rights, licenses, consents, and permissions — including written agreement from the rights holder(s) (for example, the owner of the music, sound recording, artwork, brand, or any third-party material). You are solely responsible for ensuring you have the right to use every element of your User Content, including any musical composition and sound recording rights.
SoundVisualiser is not responsible or liable for User Content. We do not pre-screen User Content and we make no representation that any content is cleared for your intended use. You bear all risk and responsibility for the legality of what you upload, render, download, publish, or distribute.
By submitting User Content you represent and warrant that: (a) you hold all rights necessary to upload it and to create and use the rendered output; (b) your User Content and its use do not infringe or violate any third party’s intellectual property, privacy, publicity, or other rights; and (c) your use complies with all applicable laws and these Terms.
You retain ownership of your User Content and of the videos you create. You grant us a limited, worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display your User Content solely as needed to operate and provide the Service to you (and, where you choose to publish, to make the published clip publicly accessible — see Publishing).
3. Acceptable use & prohibited content
You agree not to use the Service to upload, render, publish, or distribute any content that:
- you do not own or have explicit permission/agreement from the rights holder to use;
- is adult, sexually explicit, or pornographic, or that sexualises minors, or is otherwise obscene;
- is unlawful, infringing, defamatory, fraudulent, hateful, harassing, threatening, or that incites violence or discrimination;
- depicts or promotes child sexual abuse material (CSAM), terrorism, or other illegal activity;
- contains malware, or attempts to disrupt, overload, reverse-engineer, or gain unauthorised access to the Service;
- violates the privacy or publicity rights of others, or impersonates any person or entity.
You also agree not to resell, sublicense, or provide the Service to third parties except as expressly permitted, and not to misuse render quotas or circumvent plan limits.
4. Watermark & free tier
Videos rendered on the free tier include a SoundVisualiser watermark/logo. You may not remove, crop, blur, obscure, alter, or otherwise tamper with the watermark or logo on any video that was generated with it, whether by editing the file, re-encoding, or any other means. Watermark-free output is available only on eligible paid plans. Attempting to defeat the watermark is a material breach of these Terms and may result in termination.
5. Subscriptions, billing & Stripe
The Service offers a free tier and paid subscription plans (e.g., Starter, Pro, Studio). Plan features, limits, and prices are shown on our pricing page and may change as described below.
- Payment processor. Paid subscriptions are billed through Stripe. By subscribing, you also agree to Stripe’s terms. We do not collect or store your full card details; Stripe processes and stores your payment information.
- Billing cycle & auto-renewal. Paid plans are billed in advance on a recurring monthly basis. Your subscription automatically renews at the end of each billing period and your payment method is charged for the next period, until you cancel.
- Authorisation. You authorise us and Stripe to charge your payment method for the applicable fees, plus any taxes, each billing period.
- Failed payments. If a charge fails, we may retry, suspend paid features, or downgrade your account to the free tier. You remain responsible for amounts due.
- Price changes. We may change plan prices or features. We will give reasonable advance notice, and changes take effect on your next billing period. Continuing to use a paid plan after a change takes effect constitutes acceptance.
- Taxes. Fees are exclusive of taxes unless stated otherwise; you are responsible for any applicable taxes.
6. Cancellation, termination of subscription & refunds
- Cancel anytime. You may cancel your subscription at any time from your account billing portal (Stripe) or by contacting us.
- Access until the period ends. When you cancel, your subscription remains active until the end of the current paid period. The subscription is terminated after that period ends — it will not renew, no further charges are made, and your account reverts to the free tier (including the free-tier watermark and storage limits).
- No partial-period refunds. Except where required by law or expressly offered by us, payments are non-refundable and we do not provide prorated refunds for the unused portion of a billing period.
- Discretionary refunds. We may, at our sole discretion, issue full or partial refunds (processed via Stripe). Issuing a refund in one case does not obligate us to do so in any other.
- Termination by us. If we suspend or terminate your account for breach of these Terms (for example, infringing or prohibited content), you may lose access without refund.
7. Publishing & public clips
If you choose to publish a clip, you create a publicly accessible share page and you authorise us to host and display that clip publicly and to list it (for example, in a community feed). Published clips may be retained indefinitely so that share links continue to work. You may request removal of your published clip at any time, and you remain fully responsible for ensuring you hold all rights to any content you publish.
8. Copyright complaints & takedowns
We respect intellectual property rights and expect users to do the same. We are not responsible for content, including any copyrighted material, that is uploaded or added by other users. However, if you believe content on the Service infringes your rights, contact us with sufficient detail and proof of your rights, and where you can demonstrate the issue, we will remove the content.
A valid notice should include: (a) identification of the work or rights you claim are infringed; (b) the URL or share link / clip identifier of the allegedly infringing content; (c) your contact information; (d) a statement that you have a good-faith belief the use is not authorised; (e) a statement, under penalty of perjury where applicable, that the information is accurate and that you are the rights holder or authorised to act on their behalf; and (f) your signature (physical or electronic). Send copyright and legal notices to [email protected]. We may remove content, notify the affected user, and terminate repeat infringers.
9. Our intellectual property
The Service, including its software, visualizer templates, designs, branding, and the SoundVisualiser name and logo, is owned by us or our licensors and is protected by law. We grant you a limited, revocable, non-transferable license to use the Service in accordance with these Terms. You receive no rights to our trademarks or to the underlying software except as expressly stated.
10. Suspension & termination
We may suspend or terminate your access to the Service, remove content, or close your account, with or without notice, if we believe you have violated these Terms, if required by law, or to protect the Service or others. You may stop using the Service at any time. Upon termination, your right to use the Service ends; sections that by their nature should survive (including content responsibilities, disclaimers, limitation of liability, and indemnification) will survive. Stored files may be deleted in accordance with our retention practices and the Privacy Policy.
11. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that content will be cleared for your use, or that files will be preserved. You use the Service at your own risk.
12. Limitation of liability
To the maximum extent permitted by law, SoundVisualiser and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or content, arising out of or relating to your use of (or inability to use) the Service, even if advised of the possibility. To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us in the three (3) months before the event giving rise to the claim, or (b) USD 50.
13. Indemnification
You agree to defend, indemnify, and hold harmless SoundVisualiser and its owners, employees, and suppliers from and against any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising out of or related to your User Content, your use of the Service, or your violation of these Terms or any law or third-party right.
14. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, for material changes, provide reasonable notice. Your continued use of the Service after changes take effect means you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of the State of Texas, United States of America, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Travis County, Texas, except where applicable law gives you the right to bring proceedings elsewhere.
